New information! Overview of the revision of the foreign liaison registration from April 1, 2024 and explanation of required documents⑤

Good afternoon, and welcome to another installment in our series on foreign liaison registration! Today we continue our series on new information regarding foreign liaison registration.

This is another difficult topic, but the rules regarding real estate owned by foreigners have changed drastically.

Please read them carefully!

Summary of Required Documents for Registration when a Foreigner Becomes an Owner
As of April 1, 2024, in the registration procedure where a foreign resident or foreign corporation becomes the owner, the handling of address proof information will be revised in addition to the registration items of the foreigner's Roman alphabet, domestic contact information, and country of establishment compliant reporting. Therefore, although it varies from case to case, in general, the following documents should be prepared in addition to those required for registration procedures for Japanese nationals residing in Japan.

Foreigners residing in Japan
Certificate of residence with the name in romanized characters

Japanese nationals residing abroad
Certificate of domestic contact information + Letter of authorization from the domestic contact (if the contact is a domestic corporation, a certified copy and certificate of seal impression can be omitted by providing the company's corporation number, etc.; if the contact is an individual, a certificate of seal impression should be attached).

If the contact person is an individual, a certificate of seal registration is required.

Foreigners residing abroad
Affidavit + copy of passport (proof of original required)

(If the contact person is a domestic corporation, a certified copy and certificate of seal impression can be omitted by providing the company's corporation number.)

If the contact person is an individual, a certificate of seal impression should be attached.

(If there is no contact person in Japan, a letter of appeal (signed or signed and sealed by the foreigner)) ・Japanese translation of a foreign language document (partial translation can be omitted if it is stated that the translation is omitted except for the part related to certification)

Foreign corporations without a Japanese corporate identification number
Affidavit + a copy of the company's certificate of incorporation or other documents prepared by the government of the country of incorporation (proof of original is required).

(If the contact person is a domestic corporation, a certified copy and a certificate of seal impression can be omitted by providing the company's corporate identification number.)

If the contact person is an individual, a certificate of seal impression should be attached.

Japanese translation of the foreign language document (partial omission of translation is acceptable if it is stated that the translation has been omitted except for the part related to the certification).

The above documents are a general guideline for general cases. Since the required documents differ depending on the case, please check with the judicial scrivener in advance.

Conclusion
The name on a real estate registration in which a foreign individual is the owner is written in romaji in addition to Japanese.

For Japanese nationals residing abroad, foreigners without a domicile in Japan, and foreign corporations, domestic contact information is required for registration.

For foreign corporations that do not have a Japanese corporate ID number, the country of incorporation will become a registered matter.

Instead of handling an affidavit as proof of address for foreign nationals and foreign corporations that do not have an address in Japan, a copy of the passport (passport), a copy of the company certificate, etc. will be required in addition to the affidavit.

For registration of the Roman alphabet, domestic contact information, and the country of incorporation, there are required documents, so you should check with a judicial scrivener in advance.
