This is another difficult topic, but the rules regarding real estate owned by foreigners have changed drastically.

Registration in the country of the governing law of incorporation for foreign corporations that do not have a company identification number, etc. in Japan

As of April 1, 2024, a corporation that becomes the owner of real estate will be required to have a corporate identification number. In addition, when a foreign corporation that is not registered in Japan becomes the owner of real estate, the country in which the corporation was incorporated (country of governing law of incorporation) will be treated as the registered matter.

Information on Certifying the Governing Law Country of Incorporation of Foreign Corporations

The following documents are required to prove the country of incorporation of a foreign corporation.

Copy of the document of the government of the country of the applicable law of establishment

A copy of a document prepared by the government of the country of the governing law of incorporation is required. This document includes information on the address of the corporation.

The above document also serves as proof of address for the registration of real estate owned by the foreign corporation (a document equivalent to a company certificate of the foreign corporation, an affidavit, and a document prepared by the government of the country of the governing law of incorporation containing the name of the foreign corporation, etc.).

Even if the country of incorporation of the corporation is not clearly stated in the government document, if the country where the document containing the address of the corporation is located coincides with the country where the government document was prepared, that country can be used as the country of incorporation.
